The rules and responsibilities for using Ember Client. By using our services, you agree to these terms.

Welcome

These are the rules for using Ember Client and everything we offer ("the Service"), run by Clyent Softwares Ltd ("we", "us", "our"). By downloading, installing, or using Ember Client, you agree to these Terms and our Privacy Policy.

If you don't agree, don't use the Service.

Not Minecraft

Ember Client is independent software. We are not affiliated with, endorsed by, or connected to Mojang AB, Microsoft Corporation, or Minecraft in any way. "Minecraft" is a trademark of Mojang AB, used here only because our software works with their game.

Who Can Use Ember Client

  • You must be at least 13 years old.
  • If you're between 13 and 18, a parent or guardian must consent to these Terms and supervise your use.
  • Parents and guardians are responsible for everything their child does on the Service.
  • You need a valid Minecraft/Microsoft account to use the Service. We don't provide one.

Your Account

Your account is your responsibility. That means:

  • Keep your login credentials secure and don't share them.
  • Everything that happens under your account is on you, whether you did it or not.
  • Tell us immediately at [email protected] if you think someone has accessed your account without permission.
  • Give us accurate information when asked and don't impersonate anyone.

What You Can Do

You can use Ember Client for its intended purpose: enhancing your Minecraft experience within the bounds of these Terms and applicable laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes.

What You Cannot Do

Don't do any of the following. We take this seriously.

Illegal activity:

  • Break any applicable law
  • Share content involving terrorism, child exploitation, or violence
  • Incite hatred, harassment, or discrimination against anyone
  • Share content promoting self-harm or dangerous behaviour
  • Facilitate fraud, trafficking, or any other illegal activity

Harmful content:

  • Share pornographic, graphic, or age-inappropriate material
  • Upload content that exploits or endangers minors
  • Distribute malicious or deceptive content

Technical abuse:

  • Transmit viruses, malware, or harmful code
  • Attempt to access our systems, servers, or other users' accounts without authorisation
  • Interfere with or disrupt the Service
  • Reverse engineer, decompile, or extract our source code
  • Scrape, crawl, or harvest data from the Service

Misrepresentation:

  • Impersonate other users, our staff, or any third party
  • Create fake or duplicate accounts
  • Misrepresent your relationship with us or anyone else

Content You Create

If you create or share content through the Service ("User Content"):

  • You own it. We don't claim ownership of your stuff.
  • You licence it to us. By sharing it, you give us a worldwide, non-exclusive, royalty-free licence to use, host, store, reproduce, modify, and display it for the purpose of running and improving the Service. This licence ends when you delete the content or your account, except where we reasonably need to retain copies (like backups or legal compliance).
  • You're responsible for it. Make sure you have the rights to share it, that it complies with these Terms, and that it doesn't violate anyone else's rights.

Our Intellectual Property

The Service, including its software, design, branding, features, and original content, belongs to Clyent Softwares Ltd and is protected by intellectual property laws. You agree not to:

  • Copy, modify, distribute, or create derivative works from the Service
  • Reverse engineer or extract source code
  • Remove or alter any proprietary notices or branding
  • Use our intellectual property without written permission

Purchases and Virtual Items

Payments

  • Prices are shown at the point of purchase
  • Payments are handled by Tebex, our payment processor
  • You authorise charges to your chosen payment method
  • All prices include applicable taxes unless stated otherwise

Virtual Items and Cosmetics

  • Virtual items (cosmetics, capes, effects, etc.) are licenced, not sold. You receive a limited, non-transferable licence to use them within the Service.
  • Virtual items have no real-world monetary value and cannot be exchanged, traded outside the Service, or redeemed for cash.
  • We reserve the right to modify, remove, or rebalance virtual items at any time.

Refunds

  • Purchases are generally non-refundable except where required by law.
  • EU and UK consumers have statutory cancellation rights for digital content, though these may not apply once the content has been delivered with your consent.

Pricing Changes

We may change prices at any time. One-time purchases are charged at the price shown at the time of purchase. For subscriptions, we'll give you reasonable notice of any price increase before it takes effect on your next renewal - you can cancel before then if you don't want to continue at the new price.

Content Moderation

How We Moderate

We use a combination of automated tools and human review to detect and address violations of these Terms. We aim to be fair and consistent, but moderation involves judgement and we won't always get it perfectly right.

What Happens If You Break the Rules

Depending on the severity, frequency, and context:

  • Content removal
  • Account warning
  • Temporary restriction or suspension
  • Permanent ban
  • Reporting to law enforcement for illegal activity

Appeals

If you think we made a mistake, email [email protected] with:

  • What happened
  • Why you think the decision was wrong
  • Any supporting evidence

We review every appeal and will respond within a reasonable timeframe.

If you see something that violates these Terms or is illegal:

  • Use the in-app reporting tools

We investigate every report.

Complaints

For complaints about the Service or our decisions:

  2. We'll acknowledge your complaint within 2 business days
  3. We'll investigate and share our findings
  4. If you're not satisfied, you can escalate through our formal complaints process

Third-Party Services

The Service may connect to or reference third-party services, servers, and websites. We don't control them and aren't responsible for their content, policies, or practices. Use them at your own discretion and review their terms.

Termination

By Us

We can suspend or terminate your access at any time if:

  • You violate these Terms
  • You engage in illegal activity
  • We need to for legal, safety, or operational reasons

For serious violations, we may act immediately without notice.

By You

You can stop using the Service at any time by uninstalling the software. If you want your account data deleted, contact [email protected].

What Happens After

When your access ends:

  • Your licence to use the Service terminates immediately
  • We may delete your account and associated data (subject to legal retention requirements)
  • You lose access to any virtual items or purchases tied to your account
  • These Terms continue to apply where relevant (liability, IP, disputes, etc.)

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We don't guarantee:

  • The Service will be uninterrupted, secure, or error-free
  • Compatibility with all systems, devices, or game versions
  • That bugs or vulnerabilities will be fixed within any timeframe
  • Any particular level of performance or availability

Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, goodwill, or opportunity
  • Damages arising from your use or inability to use the Service
  • Actions of other users or third parties

What we don't limit: We never exclude liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or anything else that can't be excluded under English law.

Liability cap: Our total liability to you won't exceed the greater of (a) what you paid us in the 12 months before the claim, or (b) £100.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

Disputes and Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

Your statutory rights as a consumer are not affected by these Terms. Nothing here limits rights you have under consumer protection law that can't be waived by agreement.

Changes to These Terms

We can update these Terms at any time. For significant changes, we'll give you reasonable notice through:

  • In-app notifications
  • Our website or Discord
  • Email, if we have your address

If you keep using the Service after changes take effect, you're agreeing to the updated Terms.

General

  • Entire agreement. These Terms, our Privacy Policy, and any applicable annexes form the full agreement between you and Clyent Softwares Ltd for the Service.
  • Severability. If a court finds any part of these Terms unenforceable, the rest still stands.
  • Assignment. You can't transfer these Terms to someone else without our consent. We can transfer them freely.
  • No waiver. If we don't enforce something, it doesn't mean we've waived the right to.

Annex A - United Kingdom Online Safety Act

This annex applies to users located in the United Kingdom and supplements the Terms above in accordance with the Online Safety Act 2023 ("OSA"). Where this annex conflicts with the main Terms, this annex takes priority for UK users.

About This Annex

Ember Client is a user-to-user service under the OSA because users can share content that other users may encounter (such as social features, and communications). We take our obligations under the OSA seriously, including our duties regarding illegal content and the protection of children.

How We Handle Illegal Content

Under the OSA, we have a duty to protect users from illegal content. We address specific categories as follows:

Terrorism content: We prohibit all content that encourages, glorifies, or facilitates terrorism. Any terrorism-related content identified on the Service is removed immediately and reported to the relevant authorities, including referral to the Counter Terrorism Internet Referral Unit (CTIRU) where appropriate.

Child sexual exploitation and abuse (CSEA) content: We operate a zero-tolerance policy for CSEA content. Any such content is removed immediately upon identification and reported to the National Crime Agency (NCA) and/or the Internet Watch Foundation (IWF). We proactively monitor for CSEA material using automated detection tools.

Other priority illegal content: We take action against all forms of priority illegal content as defined by the OSA, including but not limited to: hate crime content, harassment and stalking, controlling or coercive behaviour, intimate image abuse (including deepfakes), fraud and financial crime, sale of illegal drugs or weapons, and content encouraging self-harm or suicide. Such content is removed promptly when identified or reported.

Proactive Technology

To fulfil our safety duties, we use the following proactive measures:

  • Automated content detection: We use automated systems to scan user-generated content for known illegal material, including hash-matching technology for CSEA imagery. These systems operate continuously across relevant parts of the Service.
  • Human review: Flagged content is reviewed by trained human moderators who assess context and make enforcement decisions. Automated systems do not make final moderation decisions in isolation.
  • User reporting tools: In-app reporting mechanisms allow users to flag content for review at any time.

Protection of Children

Ember Client is likely to be accessed by children aged 13 and over. We have conducted a Children's Access Assessment and a Children's Risk Assessment in accordance with the OSA and Ofcom's guidance.

Primary priority content (all children must be prevented from encountering):

  • Pornographic content: Prohibited entirely on the Service for all users. Any pornographic content is removed immediately upon identification.
  • Suicide and self-harm content: Content that encourages, promotes, or provides instructions for suicide or self-harm is prohibited for all users and removed immediately.
  • Eating disorder content: Content that encourages, promotes, or provides instructions for eating disorders is prohibited for all users and removed immediately.

Priority content (children in at-risk age groups must be protected):

  • Abusive or hateful content: Prohibited under our Terms. We actively moderate and remove content that is racist, homophobic, misogynistic, or otherwise hateful.
  • Bullying content: We prohibit targeted harassment and bullying. Users can block and report other users.
  • Violent content: Graphic or gratuitous violence is prohibited. We remove such content upon identification.
  • Dangerous stunts and challenges: Content promoting dangerous activities that could cause physical harm is prohibited and removed.
  • Harmful substances content: Content promoting illegal drug use or misuse of substances is prohibited and removed.

Non-designated content: We monitor for other content that may present a material risk of harm to children, including content relating to depression or body stigma, and take proportionate action where appropriate.

Age Assurance

Users must be at least 13 years old to use the Service, as stated in these Terms. We implement age gating at account registration. Because we prohibit all primary priority content for all users (not just children), our age assurance measures focus on enforcing the minimum age requirement rather than restricting specific content by age group.

Reporting and Complaints Under the OSA

Reporting illegal or harmful content: You can report content you believe is illegal or harmful to children through our in-app reporting tools or by emailing [email protected]. We aim to action reports promptly and will notify the reporter of the outcome where appropriate.

Complaints procedure: Our complaints procedure is designed to be easy to access and use, including for children. You can complain about:

  • Content you believe is illegal or harmful to children
  • A failure by us to comply with our OSA duties
  • A decision to remove your content or restrict access to it
  • A decision to suspend or ban your account

To complain, email [email protected] with details of your complaint. We will acknowledge it within 2 business days and provide a substantive response within a reasonable timeframe.

Your Right to Bring a Claim

Under Section 72 of the Online Safety Act 2023, if we remove your content, restrict access to it, or suspend or ban your account in breach of our own Terms of Service, you have the right to bring a claim against us for breach of contract. This right applies where we have acted inconsistently with our stated policies. It does not apply where we have acted in accordance with these Terms or to comply with our legal duties under the OSA.

Freedom of Expression and Privacy

In fulfilling our OSA duties, we have regard to users' rights to freedom of expression and privacy. Our moderation decisions consider the context, intent, and proportionality of any action taken. We do not take a blanket approach - each case is assessed on its own merits.
